1. Purpose and acceptance of Terms
These Terms of Service ("Terms") govern access to and use of the Berlioz AI platform (hereinafter "the Platform"), published by the company YSS (hereinafter "YSS" or "the Publisher"). By accessing the Platform, creating an account, or using any of its features, you (hereinafter "the User") accept these Terms in their entirety without reservation. If you do not accept these terms, you must immediately cease all use of the Platform. These Terms constitute a legally binding agreement between the User and YSS. The User acknowledges having read and accepted them prior to any use of the Platform.
2. Registration and user account
Access to certain features of the Platform requires the creation of a user account. You agree to provide accurate, complete, and up-to-date information during registration, and to keep it current. Any inaccurate, incomplete, or outdated information may result in the suspension or deletion of your account. You are solely responsible for maintaining the confidentiality of your login credentials and for any activity performed through your account, whether or not authorized by you. If you suspect unauthorized use or any breach of your account security, you must immediately notify YSS at support@berlioz.ai. YSS shall not be held liable for any loss or damage resulting from the User's failure to comply with their account security obligations. Each account is strictly personal and may not be shared, assigned, or transferred to a third party without prior written consent from YSS.
3. Trial periods
The Platform may offer free or reduced-rate trial periods to explore its features.
3.1 Eligibility
Trial periods are exclusively reserved for legal professionals (lawyers, legal counsels, notaries, bailiffs, judges, and any person practicing a regulated legal profession or carrying out legal activities in a professional capacity). The User agrees to provide proof of their status as a legal professional when signing up for a trial period, including any supporting documentation that YSS may reasonably request (bar registration number, professional card, business registration extract, employer certificate, or any other relevant document).
3.2 Right to refuse and cancel
YSS reserves the discretionary right to refuse, suspend, or cancel any trial period, at any time and without notice, when it considers that the trial is not legitimate, including in the following cases: - the User does not meet the eligibility conditions set out in section 3.1; - the User has provided inaccurate, incomplete, or misleading information; - the User has already benefited from a trial period, directly or indirectly (creating multiple accounts, using different email addresses, etc.); - the use of the trial period is abusive, misappropriated, or contrary to the purpose of the service; - the User is using the trial period for competitive evaluation, reverse engineering, or benchmarking purposes.
3.3 No acquired right
The granting of a trial period does not constitute an acquired right for the User. The refusal or cancellation of a trial period by YSS does not give rise to any compensation or indemnity.
3.4 End of trial period
At the end of the trial period, access to the relevant features will be automatically deactivated, unless the User subscribes to a paid plan. YSS may offer an automatic conversion to a paid subscription, of which the User will be informed in advance.
4. Pricing and subscriptions
The Platform offers different subscription plans whose pricing details are available on our dedicated page. Prices are shown in euros including VAT. Payment is made by credit card or any other payment method offered by the Platform. The subscription is automatically renewed at each billing period, unless canceled in accordance with Section 12 of these Terms. YSS reserves the right to modify its prices at any time. Any price change will be communicated to the User at least thirty (30) days before taking effect. If the User refuses the new pricing, they may cancel their subscription before the new prices take effect. Payments made are non-refundable, unless otherwise provided by applicable law.
5. User obligations
The User agrees to use the Platform in compliance with applicable laws, these Terms, and any reasonable use. It is particularly prohibited to: - disseminate illegal, defamatory, insulting, discriminatory, or immoral content; - use the Platform for fraudulent, malicious, or unintended purposes; - attempt to bypass, disable, or interfere with security measures in place; - perform automated data extraction (scraping, crawling), reverse engineering, or decompilation of all or part of the Platform; - share login credentials or allow unauthorized third parties to access their account; - use the Platform in a manner that degrades its performance or harms other users; - reproduce, copy, sell, resell, or otherwise exploit all or part of the Platform or its content without prior written authorization from YSS; - use the Platform for competitive evaluation or benchmarking purposes without prior written consent from YSS.
In the event of a breach of these obligations, YSS reserves the right to immediately suspend or terminate the User's account, without notice or prior formal demand, and without any compensation, without prejudice to any damages that YSS may claim.
6. Protection of personal data
YSS is committed to processing your personal data in compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. 7. Intellectual property
7.1 YSS rights
The Platform and all its elements (texts, images, logos, videos, source code, algorithms, databases, architecture, interfaces, documentation, etc.) are the exclusive property of YSS or its licensors, and are protected by French and international intellectual property laws, including copyright, trademark, and patent law. Any reproduction, representation, modification, publication, adaptation, commercial exploitation, or redistribution of all or part of the Platform, in any form and by any means, is strictly prohibited without prior written authorization from YSS.
7.2 Generated content
Content generated by the Platform's artificial intelligence features is produced using proprietary and third-party models. The User may use such content in the course of their professional activity, at their sole responsibility. YSS does not guarantee any intellectual property rights over AI-generated content and disclaims any liability for the User's use thereof.
7.3 User content
The User retains full ownership of all documents, files, and content they upload or generate on the Platform. Such content is strictly confidential and is used solely to provide the service to the User themselves. YSS undertakes not to access, analyze, exploit, or transmit the User's content to any third party, except where required by law by a competent judicial or administrative authority. The User's content is under no circumstances used for AI model training, service improvement, statistical analysis, or any other purpose other than the direct provision of the service to the User.
8. Limitation of liability
8.1 Service availability
YSS strives to maintain the Platform accessible 24/7 but provides no guarantee of continuous, uninterrupted availability. The Platform may be temporarily unavailable due to maintenance, updates, technical improvements, or force majeure. YSS shall not be held liable for the consequences of any interruption or unavailability, even if prolonged.
8.2 Nature of the service
The Platform provides legal research and analysis assistance tools. The information and results generated do not constitute legal advice, a professional opinion, or a consultation. YSS does not guarantee the completeness, accuracy, reliability, currency, or comprehensiveness of the information provided by the Platform. It is exclusively the User's responsibility, as a legal professional, to verify, validate, and supplement all information obtained through the Platform before any use.
8.3 Exclusion of liability
To the fullest extent permitted by applicable law, YSS disclaims all liability for: - decisions made by the User based on information obtained through the Platform; - direct or indirect damages, including data loss, revenue loss, loss of clients, commercial harm, reputational damage, or any other financial or moral harm resulting from the use or inability to use the Platform; - errors, omissions, or inaccuracies in results generated by artificial intelligence; - the use of AI-generated content in judicial or extrajudicial proceedings; - malfunctions related to the User's technical environment (Internet connection, browser, hardware); - acts of third parties, including cyberattacks.
8.4 Liability cap
In any event, YSS's total liability, for all causes combined, is limited to the total amount actually paid by the User to YSS during the twelve (12) months preceding the event giving rise to the damage.
9. Indemnification
The User agrees to indemnify, defend, and hold harmless YSS, its officers, employees, partners, and subcontractors against any claim, demand, action, suit, damage, loss, liability, cost, and expense (including reasonable attorney's fees) arising from or related to: - the User's use of the Platform; - the User's violation of these Terms; - the User's violation of any third-party rights; - content uploaded or transmitted by the User through the Platform.
10. Security and confidentiality
YSS implements technical and organizational measures in accordance with industry standards to ensure the security and confidentiality of your data. Documents and information you upload to the Platform are stored securely on servers located in the European Union. However, the User acknowledges that no data transmission over the Internet or electronic storage system is completely secure. YSS cannot guarantee the absolute security of transmitted information and disclaims any liability in the event of a security breach resulting from an event beyond its reasonable control. The User is responsible for securing their own computing environment and access credentials.
11. Use of artificial intelligence
The Platform uses artificial intelligence technologies to facilitate legal research and document analysis. These technologies rely on third-party AI models (including GPT-5, Claude Sonnet 4.5, Mistral).
11.1 No use of data for training
Your data is NEVER used to train AI models. This guarantee is contractually established with our AI providers.
11.2 AI limitations
The User acknowledges and accepts that: - results generated by AI are provided "as is" and for indicative purposes only; - AI may produce errors, inaccuracies, incomplete information, or inadequate results (including non-existent or incorrect legal references); - it is their responsibility, as a legal professional, to systematically verify all information, results, and documents generated before any use; - YSS disclaims all liability for the consequences of using AI-generated results without prior verification.
11.3 Model evolution
YSS reserves the right to modify, update, or replace the AI models used by the Platform at any time, without notice, in order to improve the quality of the service.
12. Termination
12.1 Termination by the User
You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of the current subscription period. No pro-rata refund will be granted for the remaining period.
12.2 Termination by YSS
YSS reserves the right to immediately suspend or terminate the User's access to the Platform, without notice or formal demand, in the following cases: - violation of these Terms; - provision of inaccurate or misleading information; - fraudulent, abusive, or misappropriated use of the Platform; - non-payment of amounts due; - upon request from a competent judicial or administrative authority; - for any other legitimate reason as determined at YSS's sole discretion. Termination by YSS does not entitle the User to any refund or compensation, without prejudice to any damages that YSS may seek.
12.3 Effects of termination
Upon termination, the User immediately loses access to the Platform's features associated with their subscription. YSS will retain the User's data for a period of thirty (30) days following termination, during which the User may request data export. After this period, YSS will delete the data in accordance with its Privacy Policy.
13. Modifications to Terms and service
13.1 Modifications to Terms
YSS reserves the right to modify these Terms at any time. Users will be informed of any substantial modification by email or via a notification on the Platform at least fifteen (15) days before they take effect. By continuing to use the Platform after the modifications take effect, you accept the new Terms. If you do not accept the modifications, you must stop using the Platform and cancel your account.
13.2 Service modifications
YSS reserves the right to develop, modify, suspend, or discontinue all or part of the Platform's features at any time and without notice. YSS shall not be held liable for the impact of such modifications on the User's activity.
14. Support and assistance
A support service is available to answer your questions and assist you in using the Platform. You can contact us via support@berlioz.ai. Response times may vary depending on the subscription plan you have chosen. YSS makes no commitment as to the results of the support provided.
15. Force majeure
YSS cannot be held liable for the total or partial failure to perform its obligations in the event of force majeure, as defined by Article 1218 of the French Civil Code, including technical failures, cyberattacks, natural disasters, epidemics, strikes, wars, government restrictions, third-party supplier failures, or any other unforeseeable and irresistible circumstance beyond YSS's control. In the event of force majeure lasting more than three (3) months, either party may terminate the contract as of right, without compensation.
16. General provisions
16.1 Entirety
These Terms constitute the entire agreement between the User and YSS regarding the use of the Platform, and supersede any prior agreement, written or oral, relating to the same subject matter.
16.2 Severability
If any provision of these Terms is declared null or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
16.3 Waiver
Failure by YSS to exercise any right under these Terms shall not constitute a waiver of that right.
16.4 Assignment
The User may not assign their rights and obligations under these Terms without prior written consent from YSS. YSS may freely assign these Terms to any third party, particularly in the event of a merger, acquisition, or transfer of all or part of its business.
17. Applicable law and jurisdiction
These Terms are governed by French law. In the event of a dispute relating to the validity, interpretation, or execution of these Terms, and in the absence of amicable resolution within thirty (30) days, the competent court of Paris shall have exclusive jurisdiction, including in summary proceedings, in the case of multiple defendants or third-party proceedings.
